Evidently, 41-year-old songstress Tamar Braxton and her husband Vince Herbert still have some ways to go to complete their divorce proceedings. In fact, according to The Blast, the L.A. County court has warned the pair to hurry up with their divorce.
The documents obtained by The Blast warns that Braxton and Herbert can face having their divorce dismissed over inactivity. The “Love and War” singer filed for divorce in October 2017 citing irreconcilable differences. However, Herbert has not responded to the initial filing for divorce. Still, there are some rumors circulating that Braxton hasn’t properly served her ex-husband with the proper documents of their divorce.
This rumor was made apparent by the filing of the court’s edict made against Braxton and Herbert to speed up their divorce, primarily because the court still needs to receive proof of Braxton’s filing to be able to make a default decision. If Braxton follows the warning and serves Herbert with divorce documents, the divorce proceedings can move on, even if he doesn’t sign. Nonetheless, there is now proof that she hasn’t done so.
If the former couple refuses to answer the decree or wait too long, the court can dismiss their divorce altogether. There are lingering marital issues that could likely be the culprit for Braxton’s delay. It was widely reported that she was facing major financial issues since her separation from the award-winning songwriter and producer.
There is also possibly the fact that Braxton and Herbert are still trying to work out the conditions of their divorce. If financial issues are problematic for Braxton, there could be the remote chance that Braxton is hoping to collect spousal support from Herbert. This possibility does hold some merit, especially since Herbert’s net worth is estimated to be in the $10 million range in comparison to Braxton’s $6 million dollars net worth.
Interestingly, Braxton and Herbert aren’t the only former married couple that has been ordered to hurry with their divorce. Former Hollywood couple Ben Affleck and Jen Garner were facing the same warning. Garner and Affleck split in 2015 and remained separated for nearly three years before finally reaching a divorce settlement. Similarly, the court ordered the former duo to resolve the conditions of their divorce or else their case would be dismissed.
There is also one underlying factor that could be in play in the midst of Braxton and Herbert’s divorce, which is the custody of their 4-year-old-son Logan. It has been reported by the Blast that Braxton would like to retain primary custody of their son.
It has been a full year and Herbert hasn’t responded to his former wife’s pleas for divorce. It’s confusing as to why Braxton hasn’t served Herbert, but if she refuses to, she could eliminate the possibility of their divorce from moving forward. If these reports are true, Braxton and Herbert still have some things to figure out before they’re ready to proceed with divorce. Still, according to their recent court order, they may not have much time to settle their differences before they are forced to remain married.
